SeaSpots is a digital platform that provides fishing camps, tour operators, and other service providers (collectively: "Providers") with tools for communication, information exchange, and booking organisation.

Andreas Niemann IT Consulting is neither a tour operator nor a travel agent within the meaning of §§ 651a ff. of the German Civil Code (BGB), nor a commercial agent or intermediary within the meaning of § 84 of the German Commercial Code (HGB). Contracts for travel and fishing services presented on this platform are concluded exclusively between the user and the respective Provider; Andreas Niemann IT Consulting does not become a party to these service contracts.

For Providers who list their offerings on SeaSpots and use the platform tools, the Provider Terms and Conditions, available at seaspots.net/provider-terms, apply in addition.

3. Database and Intellectual Property Protection

All compilations of accommodations, boats, fishing waters, prices, availability, and related content on this website (the "Database") are protected by:

Directive 96/9/EC of the European Parliament (Database Directive)
The Norwegian Copyright Act (Åndsverkloven)
Other applicable international protection agreements

The creation of this Database is based on substantial investment in the compilation, verification, and preparation of the data. We assert the sui generis rights to which we are entitled.

4. Permitted Use

The following uses are permitted:

Accessing the website via standard web browsers
Contacting Providers and submitting enquiries via the functions provided for that purpose
Sharing individual listings via the features provided for that purpose
Indexing publicly available content by search engines in accordance with our robots.txt
Using publicly available content for non-commercial research purposes, including the training of AI models

5. Prohibited Use

The following uses are expressly prohibited:

Automated scraping or crawling of the website or interfaces using scripts, bots, or similar tools for commercial or indirectly economic purposes
Downloading or extracting substantial portions of the Database for any purpose other than personal viewing
Republishing our content on competing platforms, price comparison portals, or aggregators
Systematically monitoring prices or availability for the purpose of competitive analysis
Circumventing or disabling technical protection measures such as access restrictions or rate limits
Commercial use of our interfaces without prior written consent
Creating competing offerings or derivative databases based on our data
Analysing or reverse-engineering our data structures, business logic, or interface architecture for competitive purposes

6. Technical Protection Measures

To protect our platform, we employ access restrictions, rate limits, and monitoring measures. Any attempt to circumvent these measures constitutes a breach of these terms and may result in criminal prosecution.

7. Consequences of Violations

In the event of violations, we reserve the right to:

Immediately block access
Assert claims for injunctive relief and damages
Obtain interim court measures
Demand reimbursement of all legal enforcement costs

Part II — Third-Party Content and Liability

9. Role of the Platform

SeaSpots provides exclusively digital tools for communication, information exchange, and booking organisation. All offerings presented on the platform — in particular fishing camps, holiday accommodations, boats, fishing waters, travel services, and organised group trips — are listed by independent Providers and are their sole responsibility.

Andreas Niemann IT Consulting does not conclude travel, rental, or accommodation contracts in its own name and does not accept payments for services provided by Providers. If a technical payment processing feature is offered via the platform in the future, these terms will be updated accordingly and the applicable payment service provider documentation will be disclosed separately. With the use of enquiry and contact functions on SeaSpots, you enter into direct contact with the respective Provider. The contracting party for any requested or booked service is exclusively the Provider.

Payments made by Providers to Andreas Niemann IT Consulting relate exclusively to the use of the platform, technical functions, and supplementary services. They do not constitute remuneration for the brokering, conclusion, or performance of travel or accommodation contracts.

10. Third-Party Content

The content presented on this platform — including descriptions of accommodations, boats, fishing waters, prices, availability, images, and other information — is provided entirely by the respective Providers and is their sole responsibility. We do not review this content for accuracy, completeness, or currency, and accept no liability or warranty in this regard.

Fishing results: We provide no guarantee whatsoever for fishing success or fishing conditions at the waters listed on the platform. Weather conditions, changes to fishing regulations, closed seasons, licence fees, and operational decisions by the respective Provider are outside our sphere of influence.

User responsibility: We recommend that users independently inform themselves about the applicable fishing regulations, entry and exit requirements, customs regulations, and other legal requirements at the destination before making a booking.

11. Limitation of Liability

Our liability for damages arising in connection with the use of the platform is limited to intent and gross negligence. In cases of ordinary negligence, we are liable only where an essential contractual obligation (cardinal obligation) has been breached, and even then only for the typically foreseeable damage.

In particular, we are not liable for:

The accuracy, completeness, or currency of Provider content
The quality, availability, or proper performance of services offered by Providers
The fulfilment or non-fulfilment of contracts between users and Providers
Fishing results, weather conditions, or official restrictions at the destination
Technical interruptions, data loss, or malfunctions of the platform, to the extent these are not attributable to intent or gross negligence

All of the above limitations of liability do not apply to damages to life, body, or health.

Part III — Final Provisions

12. Applicable Law and Jurisdiction

The entire usage relationship is governed by German law. Insofar as the user is a merchant, a legal entity under public or private law, or has their domicile or habitual residence abroad, Wolfsburg is agreed as the exclusive place of jurisdiction.

13. Severability Clause

Should individual provisions of these terms and conditions be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision will be replaced by a valid provision that comes as close as possible to the economic purpose of the invalid provision.

14. Changes to Terms

We reserve the right to amend these terms and conditions as necessary. Registered users will be informed of material changes in advance. Continued use of our services following notification of changes shall constitute acceptance of the amended terms.

15. Online Dispute Resolution

The European Commission provides a platform for out-of-court dispute resolution at ec.europa.eu/consumers/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
